Aria Labs, Inc. ("Aria Labs," "we," "our," or "us") respects your privacy. This Privacy Notice explains how we collect, use, disclose, and safeguard information when you use our applications, games, websites, software, and related services, including, but not limited to:

  • Upcycle and other downloadable software and plugins
  • Any other applications, games, software, websites, or services published by Aria Labs, Inc.

By downloading, accessing, purchasing, or using our products, you acknowledge this Privacy Notice and agree to the practices described herein.

1. Who We Are

Aria Labs, Inc. is a Delaware corporation that develops interactive music creation games, creative software, and digital instruments. Our products are designed to let users create music through gameplay and digital creative tools that we call songtoys.

2. Information We Collect

We intentionally collect as little information as reasonably necessary to operate, improve, support, and market our products. The information we collect depends on how you interact with us.

Analytics and Usage Data

Our applications and websites automatically collect limited analytics and technical information that helps us understand how our products are being used and how they can be improved. Depending on the product and platform, this information may include:

  • Country or region (coarse location inferred by analytics providers)

The analytics information we collect is used solely to:

  • Improve gameplay and user experience

Where practical, this information is collected in aggregated or pseudonymous form.

We do not use analytics data to identify individual users, track users across unrelated applications or websites for profiling, or build personal profiles unrelated to our own products and services.

Order and Purchase Data

When you purchase a product directly from arialabs.io, we and our payment processors collect information needed to complete the transaction, fulfill your order, and provide support. This may include:

  • Email address
  • Billing country and (where required) state or postal code
  • Payment processor transaction ID and session ID
  • Purchase amount, currency, and product purchased
  • License key generated for your order
  • IP address, browser user agent, and referring URL
  • Marketing campaign identifiers (such as UTM parameters and Meta click identifiers)
  • Whether a download has been accessed and the timestamp of access
  • License key activation or usage records (if and when activation occurs)

Payment card details are collected and processed directly by Stripe, Inc. or other authorized payment processors. Aria Labs does not directly receive or store your complete payment card information.

Purchases made through mobile app stores (Apple App Store, Google Play Store) are processed entirely by the platform provider. We do not receive your payment card information for those transactions, though we may receive limited transaction information necessary to confirm the purchase.

Marketing and Attribution Data

When you visit our website or interact with our marketing, we may collect information used to measure the effectiveness of our advertising and to understand how users discover our products. This may include:

  • Meta Pixel and Facebook/Meta click identifiers (fbclid)
  • UTM parameters (source, medium, campaign, term, content)
  • Page views and interactions on arialabs.io
  • Cookie and similar technology identifiers
  • IP address, browser type, and device type

This information is used for conversion tracking, ad attribution, and improving our marketing campaigns. It is not sold to third parties for unrelated advertising purposes.

Information We Do Not Intentionally Collect

We do not intentionally collect or store:

  • Your name (unless voluntarily provided in a support request)
  • Phone number
  • Home address
  • Contacts
  • Photos
  • Audio recordings
  • Messages
  • Government-issued identifiers
  • Complete payment card information

3. How We Use Information

We use the information we collect to:

  • Deliver software downloads and issue license keys
  • Send purchase receipts, license key reminders, and support-related communications
  • Provide customer support and respond to inquiries
  • Improve gameplay, user experience, and product performance

We do not sell your personal information. We do not use collected information for behavioral advertising unrelated to our own products, advertising profiling across unrelated sites, or automated decision-making about individual users.

4. Service Providers and Analytics Providers

We use trusted third-party service providers to help us operate, improve, and market our products. These providers may process information on our behalf. Examples include:

  • Stripe, Inc. — payment processing and order management
  • Meta Platforms, Inc. — conversion tracking and advertising attribution (Meta Pixel / Conversions API)
  • Resend, Inc. — transactional email delivery
  • Firebase Analytics, Firebase Crashlytics, GameAnalytics, Unity Analytics — analytics and crash reporting
  • Apple App Analytics and Google Play Console Analytics — platform analytics

The service providers we use may change over time as our products evolve. We select providers that maintain reasonable security and privacy practices.

5. Cookies and Similar Technologies

Our website uses cookies and similar technologies to operate the site, remember preferences, and support marketing attribution. This includes cookies and scripts used by Meta to measure ad conversions.

You can manage or disable cookies through your browser settings. Some features, such as checkout or remembering your preferences, may not function properly if cookies are disabled.

6. Children's Privacy

Our products are intended for a general audience. We do not knowingly collect personal information from children under 13. If we become aware that personal information has been collected from a child in violation of applicable law, we will take reasonable steps to delete that information. Parents or guardians who believe a child may have provided personal information may contact us using the information below.

We retain information only for as long as reasonably necessary to:

  • Fulfill orders and honor license entitlements

Order and purchase records are generally retained for as long as necessary to support license entitlements, handle refunds or disputes, and meet tax and accounting obligations. Retention periods may vary depending on the service provider and applicable legal requirements.

We use commercially reasonable administrative, technical, and organizational safeguards designed to protect the information we collect against unauthorized access, disclosure, alteration, or destruction. However, no method of electronic transmission or storage is completely secure. Accordingly, we cannot guarantee absolute security.

Our products and services may rely on cloud infrastructure and third-party service providers located in countries other than your own, including the United States. As a result, information may be processed in jurisdictions whose privacy laws differ from those in your country of residence.

Depending on where you live, you may have legal rights regarding information collected about you, including the right to:

11. California Privacy Rights

If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). Aria Labs does not:

  • Sell personal information
  • Share personal information for cross-context behavioral advertising.
  • Use sensitive personal information for purposes requiring additional disclosures under applicable law.

We may share personal information with service providers for business purposes such as payment processing, order fulfillment, email delivery, analytics, and advertising attribution. These disclosures are not considered "sales" under the CCPA/CPRA.

12. European Privacy Rights

If you are located in the European Economic Area (EEA), the United Kingdom, Switzerland, or another jurisdiction with similar privacy laws, our legal basis for processing analytics information is our legitimate interest in operating, maintaining, securing, and improving our products. Our legal basis for processing order and purchase data is performance of a contract with you (the purchase) and our legitimate interests in fulfilling orders, preventing fraud, and supporting our customers. Marketing and attribution data is processed based on consent (where required by law) or our legitimate interest in measuring advertising effectiveness.

13. Advertising and Marketing

Our applications do not display behavioral advertising. We may use advertising to promote our own products on third-party platforms (such as Meta). We use Meta Pixel and the Meta Conversions API to measure how our ads perform and to attribute conversions. This is limited to understanding the effectiveness of our own marketing; we do not build advertising profiles for unrelated purposes or sell user information to advertisers.

If advertising or monetization practices change in the future, this Privacy Notice will be updated accordingly.

14. Third-Party Services

Our applications and website integrate with services provided by Apple, Google, Stripe, Meta, Resend, and other trusted technology providers to support functionality, payments, analytics, distribution, email delivery, marketing attribution, and platform services.

Your use of those third-party services is governed by their respective privacy notices and terms of service.

15. Changes to This Privacy Notice

We may update this Privacy Notice from time to time. If we make material changes, we will revise the Effective Date at the top of this Privacy Notice.

We encourage you to review this Privacy Notice periodically to stay informed about our privacy practices. Your continued use of our products after any changes become effective constitutes your acceptance of the revised Privacy Notice.
